The fundamentals of fatwa and its manners

The fatwa language is the answer to a question, then the word was specialized for the answer to a religious question, meaning today: "the answer to a religious matter," and the reason for choosing the term religious "without legal" is because the mufti does not only answer about the practical legal rulings; rather, he may also answer about doctrinal religious issues, about the meaning of hadiths, how to chain their narration, and other matters related to religion and its sciences. And the word fatwa and issuing fatwa are divided into three sections: the legislative fatwa, the jurisprudential fatwa, and the penal fatwa. As for the legislative fatwa, it is issued by the Lawgiver, either through revealed speech in the Holy Quran, or through non-recited revelation in the Sunnah of the Prophet, peace be upon him, in response to a question, or to clarify an incident during the time of the Prophet, peace be upon him, and thus became a general law.
