The jurisprudential preference among Maliki scholars of the Islamic West: its roots and developments

It is the ruler in the matters of people and their practical affairs. It is described as being a matter of ijtihad in which the opinions of the scholars differed and their answers varied, which resulted in a huge jurisprudential wealth. This is evidenced by the many jurisprudential opinions on a single subsidiary issue. This situation placed scholars in front of a problem of searching for the accepted priorities to adopt and prefer one jurisprudential opinion over another. This preference requires a significant amount of balancing and discussion of those opinions, reviewing the texts they are based on, as well as having rules, standards, and conditions that must be followed, along with precise criteria that must be adhered to, in order to reach the most likely and accepted opinion from the various views.
