About the book:
Three studies on recent commercial developments according to the Saudi system, which are as follows:
First research:
The subject of selling future objects is considered one of the important transaction issues nowadays, due to the questions it raises among traders, farmers, company owners, and factory owners regarding the regulation of the Saudi civil transactions system, the regulator's control over it, and its importance. This study was conducted to highlight the importance of selling future objects and their effects in the Saudi civil transactions system and Islamic jurisprudence, as well as to identify points of agreement and disagreement between them, and to remove any confusion that might occur on such topics.
Second research:
The study included the nature of custom in terms of its definition, the difference between it and customary practice, the pillars of custom, and its advantages. It also covered the role of custom in contractual relations, in expressing intent whether verbally, in writing, by gesture, through tacit agreement, or silence. The role of custom in interpreting the will of the contracting parties and in proving the claim, whether by writing or by circumstantial evidence. The study also included some practical applications of the role of custom in contractual relations, such as its role in the sale contract, regarding the non-recognition of minor ignorance about the sold item, estimating the price, determining sale accessories, and defining the obligations of the buyers and sellers, including the place and time of delivery and payment. Additionally, the role of custom in the deposit contract was discussed, including the assumption and estimation of the fee, its timing and location, and the criteria for safeguarding the deposit and the standard of custody.
Third research:
This research addressed the nature of wages, including their definition, conditions for entitlement, importance, and methods of determination, whether by mutual agreement or by the specialized committee. The study covered types of wages, such as monetary wages and in-kind wages, as well as legal protections for wages, including setting a minimum limit. It also included provisions for fulfilling wages, such as the place and time of payment, and means of proof for the worker. The study further discussed guarantees for the fulfillment of wages, including the worker’s right to a lien on wages and protection of wages against the employer, as well as protection from creditors and oneself.
