About the Book:
The emergence of international criminal law was a response to the need of the oppressed in the international community for a legal mechanism that contributes to protecting shared human values, deterring perpetrators of the most serious crimes that threaten international peace and security. It enshrines the principle of non-impunity and ensures accountability for individuals who commit serious violations of human rights and fundamental rules of international humanitarian law.
This branch of law has become an embodiment of the balance between the principle of national sovereignty and the necessity of achieving international justice, as well as the requirements of politics and the demands of law based on institutional legal rules that are independent international legal standards, not the application of victorious justice rules.
The book also aims to clarify the relationship between national sovereignty and the requirements of international criminal justice. It sheds light on the treatment of international criminal law from the perspective of Sharia and law, and reviews the legal issues raised by practical application, whether in terms of defining international crimes or applying the principle of complementarity between national and international judiciary, and the fundamental principles it stipulates such as non-prescription, non-assertion of immunity, etc.
It seeks to provide a critical analysis of international judicial precedents, identify shortcomings, and explore future challenges facing the application of international criminal law amid contemporary political and technological changes.
This book covers the general provisions of international criminal law, its development and sources, international crimes, the subject matter jurisdiction of the International Criminal Court, international criminal responsibility, civil liability for compensation for international crimes, and the entities responsible for compensating the victim.
It also discusses the international criminal judiciary and its development through the study of ad hoc and permanent international courts, analyzing their legal structure and regional and substantive jurisdictions, with a focus on the challenges faced by the International Criminal Court.
Furthermore, it examines guarantees of criminal justice during the investigation and trial phases under the Rome Statute, including guarantees of criminal justice before the investigative authority, guarantees before the International Criminal Court, and the rights of the victim. It clarifies the impact of these guarantees stipulated in the Rome Statute in ensuring a fair trial for the accused, and how well these guarantees align with those established from an Islamic Sharia perspective and national legislations.
The book evaluates the role of the International Criminal Court and the activation of international judicial cooperation in areas such as extradition, exchange of evidence, legal assistance, and enforcement of judgments against criminals.
In conclusion, I pray to Allah that I have succeeded in making this work a building block added to the scientific efforts aimed at consolidating methods of benefiting from the justice of international criminal law. May Allah accept my work in this world and the Hereafter, and make it beneficial for Muslims.
