Scope of application of the International Sale of Goods Convention: A study in light of judicial precedents based on UNCITRAL texts
The Kingdom officially joined the United Nations Convention on Contracts for the International Sale of Goods (CISG), becoming the 96th country to join the convention. It will become an integral part of its legal system once it enters into force, and therefore I have drafted a work on the scope of application of the convention in light of judicial precedents based on UNCITRAL texts.
Especially since the success of applying the convention in the Kingdom depends not only on the consistency of its provisions and the harmony of its texts but also on studying it in a deep, non-superficial manner and clarifying its scope of application. It relates to international sale, which is derived from its name, "United Nations Convention on Contracts for the International Sale of Goods," and it was logical for its provisions to begin with stating the international controls that set the boundaries between international sale subject to it and domestic sale outside its scope.
As the preamble of the convention also states, the goal it aims to achieve is to establish a new international economic system, develop international trade, and organize international sale contracts of goods. Article 7 of the convention explicitly states in its first and second paragraphs that "regard shall be had to the international character" when interpreting it.
