Product description

The activity of providing labor services is a solution proposed by the Saudi regulator to alleviate the burden of recruitment on the employer, including the obligation to pay wages throughout the recruitment period, providing housing and insurance for the worker, and similar matters; along with the delays in the worker’s arrival to the country or discovering their lack of experience in the specialization for which they were recruited, which causes the recruit to incur greater losses and expenses. In this case, it is better for the employer to contract with licensed entities authorized to carry out this activity, which are responsible for providing the worker in the desired specialization, a worker who has already been recruited by this entity, and made available to those in need of their services from employers. This regulation will save employers many burdens, and help the state in gaining more control over the recruitment activity when a large entity sponsors a number of workers, making it responsible for selecting them according to the country's needs for their services and their expertise in their field, providing them with training, knowledge, and rights that ensure they perform their work in the best way and in a manner that meets actual needs without exaggeration or exploitation, and guarantees the greatest possible discipline in the labor community. Since this labor activity, in its systematic manner, is a new activity in the Kingdom, its implementation raises many issues, as it is a distinguished contract, because the parties involved are three, combining the licensed entity, the worker, and the client; which requires studies and research to clarify the nature of this intertwined relationship, and to specify each party’s obligations, limits of responsibility, and the effects of that responsibility.
