The privilege in financial transactions and its rulings in Islamic jurisprudence
Dr. Ibrahim bin Saleh bin Ibrahim Al-Tanemi
This thesis discusses one of the modern financial issues that have become increasingly necessary in our current time, known as "the right of privilege," which refers to the trademark, or the trade and industrial name of the product, or what is known as commercial reputation. In our era, many intellectual rights with financial value have become subject to the jurisdiction of their owners and the extent of their authority over them, which is a matter of research and discussion. The author believes that this term is closely related to similar terms of the past, such as specialization, monopoly, advancement, and the like. The author discusses the legitimacy of this right legally, due to its current economic importance in the field of commercial activity.
The author's thesis discusses the documentation of the "right of privilege" from two aspects:
One: its definition and establishment from one side.
And the second: proving the possibility of applying this establishment to branches of the issue from another side.
This study is based on two main chapters: one theoretical and foundational, and the other practical and applied.
The aim of this study is to reach the following matters:
1- Broad overview and scientific enrichment in jurisprudential studies of contemporary emerging issues in light of Islamic Sharia.
2- Knowing the rulings of Islamic Sharia regarding issues and matters of privilege.
3- Purifying the issues of privilege and its details from everything that contradicts the rulings of pure Islamic Sharia, and proposing appropriate legal alternatives.
4- Equipping public and private libraries, government departments, and Islamic banks with a specialized publication accessible to those interested in this type of transactions.
