Introduction
Praise be to Allah alone, and blessings and peace be upon our Prophet Muhammad and his family and companions.
To proceed:
The system of Sharia procedures issued by Royal Decree No. M/1 on 22/1/1435 AH and its executive regulation issued by Minister of Justice Decision No. 39933 on 19/5/1435 AH is effective procedurally in all courts of general jurisdiction in the Kingdom of Saudi Arabia.
Article One of this system indicates that courts should adhere in their procedures for hearing cases before them to what is stated in the system of Sharia procedures. As stated in Article Eighteen hundred and twenty-one of the Code of Criminal Procedure issued by Royal Decree No. M/2 on 22/1/1435 AH, the provisions of the system of Sharia procedures are applied where no provision is made in this system and where it does not conflict with the nature of criminal cases.
Article Two of the Enforcement System issued by Royal Decree No. M/53 on 13/8/1433 AH clarifies that the provisions of the system of Sharia procedures are followed before the Enforcement Judge unless this system states otherwise.
The executive regulation of Article One of the system of Sharia procedures states that the applicable systems, decisions, and instructions issued by the competent authorities that do not conflict with this system are followed.
The idea of this book is to connect the articles of the system on one side, and on the other side, to combine the system, its regulation, and related matters as follows:
First: Systems.
Second: Principles of the Supreme Court, issued pursuant to Paragraph (A/2) of Article Thirteen of the Judicial System issued by Royal Decree No. M/78 on 19/9/1428 AH, published on the website of the Supreme Judicial Council.
Third: The Judicial Inspection Code, First Edition, approved by the Supreme Judicial Council Decision No. 36/12/1352 on 18/1/1436 AH, issued and published by the Research Center at the Ministry of Justice.
Fourth: Principles and decisions issued by the Higher Judicial Authority, the Permanent and General Authority of the Supreme Judicial Council, and the Supreme Court from 1391 AH to 1437 AH (First Edition 1438 AH - 2017 AD), issued and published by the Research Center at the Ministry of Justice.
Fifth: Judicial and court regulations and circulars.
This book contains the system of Sharia procedures according to the amendment issued by Ministry of Justice Royal Decree No. M/14 on 22/2/1440 AH, as included in the courts' circular from the Ministry of Justice No. 13/T/7591 on 12/3/1440 AH, as well as the amendment issued by Royal Decree No. M/38 on 30/3/1441 AH, included in the courts' circular from the Ministry of Justice No. 13/T/7954 on 7/4/1441 AH.
It also includes the executive regulation of this system according to the amendments issued based on the following:
A - Decision of the Minister of Justice No. 13/T/7007 on 12/2/1439 AH.
B - Decision of the Minister of Justice No. 841 on 16/3/1439 AH, communicated via Ministry of Justice Circular No. 13/T/7057 on 24/3/1439 AH.
C - Decision of the Minister of Justice No. 1968 on 9/6/1439 AH, communicated via Ministry of Justice Circular No. 13/T/7226 on 10/6/1439 AH.
D - Decision of the Minister of Justice No. 5062 on 7/9/1440 AH, communicated via Ministry of Justice Circular No. 13/T/7778 on 9/9/1440 AH.
Given my connection to the system of Sharia procedures through my study at the Higher Institute of Judiciary in Riyadh, and my supplementary research to obtain a master's degree in Islamic Policy (Systems Department) from the Higher Institute of Judiciary in Riyadh, which focused on the system of Sharia procedures, and my years of work in the judiciary and explaining it to judicial interns at the General Court in Dammam—during my work there as a judge and member of the department handling large lawsuits—and my contribution to spreading judicial culture for anyone interested in the work of the judicial system in the Kingdom of Saudi Arabia, this book was created. I named it "The Comprehensive Judicial System on the System of Sharia Procedures."
May Allah send blessings and peace upon our Prophet Muhammad, his family, and all his companions.
