Regulation of Judicial Rulings
In the name of Allah, the Most Merciful, the Most Compassionate
Introduction
Praise be to Allah, Lord of the worlds, the best of judges, the Disposer of the Day of Judgment, the Day of Great Judgment, and the separation between disputants. Peace and blessings be upon the noblest of prophets and messengers.
To proceed:
Indeed, judgment follows prophecy, and the work of the prophets, and the righteous scholars. Through it, the implementation of Shariah rulings is carried out, their virtues clarified, their jurisprudence developed, and renewed.
Judgment means: entering between the Creator and the creation to carry out His commands and rulings through the Book and the Sunnah.
Judges are deputies of the caliphs in adjudicating disputes among people, and they serve under their governors in their regions. Since the dawn of Islam, the judiciary has been overseen by great scholars and eminent mujtahids. Allah, the Most High, mentioned His servant Dawood, praising him, saying:
“And We granted him wisdom and decisive speech.”
Al-Hasan Al-Basri said: it is the knowledge of judgment, and thus the consideration of what the judge rules has a great matter. Scholars have elaborated on it and established it.
One of the most significant concerns of modern states is legislation and judicial laws, as they are the hallmark of justice, strength, prestige, and pride.
If you want to examine the uprightness and strength of a nation, look at its judiciary. If it is upright, the rest of its affairs will be upright; if it is corrupt, it will corrupt others.
There has been much discussion about the regulation of judicial jurisprudence rulings (transactions, personal status, crimes, and compelling judges to rule accordingly). Some researchers have studied and presented it, supporting and opposing.
Considering the immense importance of this subject, I wanted to present here a summary of what I have written, striving to show the viewpoints as they are, without bias, and then to share what I have concluded from it.
I ask my Lord and Master for help, success, guidance, and righteousness. He is the Most Generous of those responsible and the Guide to the right path.
