In conclusion, at the end of this study; I turn to God Almighty with supplication and earnestness; that He accept this humble work from me, and that He make me obedient to Him, fill my heart with reverence and love for Him, and surround me with His care and protection. I ask Him — Glory be to Him — to forgive me, my parents, my brothers, and my teachers, and to guide our steps on His path, and to seal my fate and theirs with goodness.
Below are a summary of the most important results reached by the research:
1. The principle of considering outcomes is one of the most important rules on which the science of the objectives of Sharia is based, due to its characteristics of purposefulness, realism, and aiming to balance between interests and harms. These elements are undoubtedly the core axes from which the consideration of the objectives of legislation is derived.
2. The rich foundational treasury we possess is abundant with rules of applied ijtihad in new issues, as well as many controls, pathways, and procedural rules related to organizing the organic links between sources of Islamic rulings and the renewed interests in real life. This richness and adherence to general values and essential objectives are characterized by comprehensiveness, realism, and flexibility.
3. The theory of considering outcomes is fundamentally based on taking into account the results of actions and deeds, aiming for their effects to realize public and private interests, while emphasizing the necessity of consistency between the intention of the accountable person in compliance and the intention of the Legislator in establishing obligations.
4. Ijtihad that neglects observing the objectives and does not consider the outcomes of actions is, in fact, an incomplete effort, and its practitioner may contradict the objectives of Sharia and cause harms that the pure Sharia has disavowed.
5. Considering outcomes is an original principle that the Legislator observed in itself in the implementation of rulings, and it was adopted by the Companions, may Allah be pleased with them, after the Prophet, peace be upon him. It is clearly evident in the ijtihad of our leader Umar ibn Al-Khattab, may Allah be pleased with him, in particular. His jurisprudence is rightly considered "the jurisprudence of outcomes." Moreover, the imams of ijtihad may also have observed it in their efforts, especially evident in the Maliki, Hanbali, then Hanafi, and Shafi'i schools. The Malikis and Hanbalis are the most concerned with objectives and taking outcomes into account among the schools, contrary to the common misconception that the Hanbali school is solely based on texts. In my view, this is due to the widespread mistake of assuming a causal relationship between texts and objectives. Therefore, this research has attempted in several places to prove that the objective is an intrinsic element in the structure of the text itself, not something external to it, as is commonly believed.
6. "Blocking the means," "Invalidating tricks," "Istihsan" (juridical preference), and "considering differences" are procedural rules that organize ijtihad, and they are not evidence in opposition to the legal texts, as many scholars have done. Considering them as part of the "evidence" is one of the main reasons that provoked some scholars to criticize them.
7. The general texts of Sharia and their methods in implementing rulings are sufficient to provide all procedural rules and pathways to improve people's reality. There is no need to import systems and approaches from worldly legislations that have not benefited their own people, let alone others.
8. Sharia does not limit the consideration of outcomes to what is already realized and actualized only, but it also extends to observing what is expected in the near future. Therefore, the preventive and therapeutic approach represents the two wings of the outcomes-based ijtihad, based on specific controls that ensure the soundness of that ijtihad.
9. Analyzing the actions of Sharia in its sources and resources guides to a very precise methodology in balancing and weighing interests and harms, which ensures the stability of the affairs of the nation and their proper management in the best and most excellent manner.
May Allah's peace and blessings be upon our Prophet Muhammad, his family, and companions altogether.
And our last supplication is: Praise be to Allah, Lord of the worlds.
