This book examines criminal policy for combating corruption in light of the interaction between international obligations and national requirements, drawing on the experiences of the Kingdom of Saudi Arabia and the Republic of Tunisia.
It begins by tracing the transformation of anti-corruption efforts since the 1990s, as international attention to the phenomenon intensified and a number of regional and international conventions were concluded, foremost among them the United Nations Convention against Corruption, alongside the development of national policies in this field.
The book highlights the key international standards governing anti-corruption efforts and the extent to which they have been reflected in national laws and regulations. It examines prevention and deterrence policies, the roles of specialized anti-corruption institutions in both countries, the procedural particularities of prosecuting corruption offences, and the mechanisms and challenges of international cooperation.
The book concludes that international obligations have helped shape national policies toward the development of integrated anti-corruption frameworks combining prevention, criminalization, and remedial measures, while allowing states sufficient latitude to accommodate their legislative and institutional particularities.
It further emphasizes that international standards and national particularities are complementary, bringing together common fundamental principles while preserving the flexibility needed to adapt them to national contexts.
Accordingly, the book recommends strengthening the alignment of national legislation with international obligations and advancing digital transparency through the digitalization of government services and the establishment of national information systems that support evidence-based policymaking.
It also calls for more effective international cooperation, particularly in the areas of mutual legal assistance and asset recovery; the establishment of permanent coordination channels among the relevant judicial and law-enforcement authorities; greater engagement in specialized international networks for tracing and recovering assets; and more effective use of legal tools supporting financial investigations into transnational corruption cases.
