Product description

Despite the brevity of the text, the author was able to analyze the phenomenon of the impact of political bias in jurisprudence throughout Islamic history and its present. Starting with defining the conceptual framework, where the concept of bias was explained, followed by formulating the problematic of the topic. Then, in the first chapter, the stance of the Quran and the noble Sunnah on the phenomenon of bias was examined. The second chapter focused on studying the transformations of jurisprudential discourse, and the relationships of influence and impact that existed between jurisprudence as a discourse issued by the legitimate scholarly community and the prevailing political system. It analyzed the changes that occurred in jurisprudential discourse throughout history, including the shift of the jurist of Sharia into what was called the "jurist of the Sultan," and the impact of this shift on formulating a set of jurisprudential determinants. These led to important results, most notably the author concluding with a final chapter dedicated to proposing a set of solutions, ranging from doctrinal and intellectual to foundational and purposive.
